MSHA agenda identifies planned silica implementation revisions

MSHA’s August 2026 agenda identifies planned implementation changes under RIN 1219-AC22 without establishing a new compliance date.

October 7, 2026

Exposure monitoring, compliance methods, respiratory protection and medical surveillance are the subjects of a planned MSHA silica revision listed in the August 14, 2026 Unified Agenda. The entry is RIN 1219-AC22 and describes a rulemaking being prepared to address issues raised in litigation over the 2024 rule.

APT’s MSHA silica regulatory agenda tracker record identifies the planned revision and its rulemaking identifier.

What the agenda establishes

The entry identifies the agency’s intended subjects and places the action in the proposed-rule stage. It describes changes to part 60 and associated conforming amendments. It also reports that enforcement of the 2024 requirements was paused following a judicial stay.

An agenda entry describes an agency plan. The timetable’s July 2026 target does not demonstrate that a notice of proposed rulemaking was published that month. The entry gives no legal deadline, and this report establishes no adopted amendment or employer compliance date.

The April 2026 notice addresses the separate delay to conforming amendments in parts 56 and 57. That notice and the agenda serve different purposes: one records an agency action following the stay; the other outlines work the agency intends to undertake.

Follow the revision by its identifier

APT’s practical interpretation is to retain RIN 1219-AC22 in the regulatory watch list and compare any later published proposal with the existing exposure program. Sampling responsibilities, methods of compliance and medical-surveillance provisions would need to be read in the actual proposal before their operational effects could be assessed.

The older silica rulemaking carries a different RIN, 1219-AB36. A document for that earlier proceeding should not be treated as the planned revision merely because both concern silica. A Federal Register search under RIN 1219-AC22 through October 7, 2026 returned no matching published document. The agency agenda entry remains a proposed-rule-stage plan. The scoped check establishes no published NPRM or implementation date.
