Minnesota OSHA has posted draft lead standards for general industry and construction while gathering feedback ahead of formal rulemaking. The DLI page explicitly states that posting the drafts does not begin the formal process under Minnesota Statutes section 182.655.
APT’s Minnesota lead standards draft tracker record keeps the posted drafts separate from formal rulemaking and adoption.
Publication in the State Register has a separate role
DLI says the formal process and official comment period begin when proposed rules are published in the Minnesota State Register. Its page links August 2025 draft standards and explains that their presentation uses federal standards as a starting point. The eventual Minnesota proposal would be formatted as state rules.
The construction draft is therefore review material. Its presence on the agency website does not establish adoption or make a proposed numerical value an operative requirement.
DLI connects the work to a legislative direction to reduce blood-lead levels used for medical removal and return to exposed work. That medical-surveillance subject should remain distinct from a claim that all airborne lead limits have changed.
Review the program against the applicable standard
APT’s practical interpretation is to identify the current standard covering each operation and retain exposure and medical-surveillance records in a form that can support a later comparison. The state’s draft may help employers understand subjects under consideration, but a compliance calendar needs an adopted instrument and its actual dates.
DLI’s page, checked October 7, 2026, still describes preparation before formal rulemaking. The State Register cumulative rule indexes reviewed through October 5 identified no later lead-specific proposal or adoption. An August 2026 notice under rule 5205.0010 concerned Hazard Communication corrections. This scoped check supports reporting the draft stage and establishes no new lead threshold.
