New Brunswick’s exposure-limit definition uses the 2016 ACGIH publication, with explicit exceptions. The current General Regulation 91-191 identifies that edition in section 2. Updating a reference library alone does not change the edition incorporated by the regulation.
WorkSafeNB’s regulation hub records January 9, 2025 as the start of full enforcement of the amended General Regulation. That milestone followed the agency’s implementation period. It does not establish that every amended provision first commenced on that date.
The New Brunswick enforcement record connects the agency milestone with the underlying regulation. WorkSafeNB’s exposure-limit guidance gives the provincial interpretation route.
Check exceptions within the adopted definition
Section 2 includes specific treatment for substances such as lead sulfide and formaldehyde and allows exposure limits set by the Commission. The incorporated edition needs to be read together with those exceptions. Each applicable exception and its amendment history need to be checked in the governing text.
APT’s practical interpretation is to identify both the adopted edition and any applicable substance-specific provision in the workplace register. Historical program records can separately retain the January 2025 enforcement milestone. A workplace subject to federal law or another sector regime requires its own jurisdiction assessment.
