NSW silica exceedance reporting starts from receipt of the monitoring result

NSW silica exceedance reporting starts from receipt of the monitoring result. Coverage, dates and source evidence for EHS teams.

October 7, 2026

NSW requires reporting when monitoring for high-risk crystalline-silica-substance processing shows an exceedance of the applicable workplace exposure standard. SafeWork NSW’s notification guidance requires notice and the air-monitoring report as soon as reasonably practicable, within 14 days of receiving the result.

The current Work Health and Safety Regulation 2025, section 529CE, retains that timing and high-risk processing scope. The consolidation checked on October 7, 2026 displayed a version beginning July 3, 2026.

The NSW silica-reporting record preserves the original September 1, 2024 implementation event. The agency’s technical fact sheet supplies related monitoring context.

Preserve the result-receipt date

The agency identifies 0.05 mg/m³ as the eight-hour respirable crystalline silica standard and notes adjusted values for extended shifts. It requires monitoring reports to be kept for 30 years and made available to people at the workplace who may have been exposed, with appropriate privacy handling.

APT’s practical interpretation is to record when the PCBU receives a result alongside the sampling date and report. That makes the reporting clock traceable. The notification requirement discussed here concerns relevant high-risk processing; other particulate samples and different sampling fractions require their own applicable reporting and assessment basis.
